In 2018, two Sedalia residents were charged with a felony for allegedly setting a fire in their own home. Both subjects entered Alford pleas and were sentenced to supervised probation, but one is due back in court in the coming weeks for allegedly violating his probation.

A probable-cause statement says authorities responded to structure fire at a residence in the 2700 block of Wing Avenue on May 4. Authorities contacted the residents of the home- Robert Modrall and Nicole Vallery- who were staying at a nearby motel they said due to problems with a water heater.

During the investigation, the presence of “weathered gasoline” was found in a carpet sample taken from the basement of the residence, and the water heater was in good working order. Also, video surveillance showed both subjects leaving the motel about 20 minutes before the fire was reported; and they returned several minutes afterward.

Modrall entered an Alford Plea to a Class D Felony for Second-Degree Arson and was sentenced to five years in the Missouri Department of Corrections on April 15, 2019. However, the sentence was suspended, and Modrall, who is now 40 years old, was sentenced to five years of supervised probation.

The court filed a probation-violation charge against Modrall on September 1, 2020. Modrall posted surety bond on September 11.

Modrall is due for a hearing at 1:30 p.m. on Monday, February 1, at Pettis County Circuit Court.

Vallery entered an Alford plea on March 4, 2019, and still is serving five years of supervised probation.
