The prosecuting attorney in the case involving a Clinton man accused of shooting to death a Henry County law-enforcement officer has notified the court that he will be seeking capital punishment.
According to online court documents, 39-year-old Ian McCarthy has been charged with a Class A Felony for Murder in the First Degree; a Class D Felony for Unlawful Possession of a Firearm; and an Unclassified Felony for Armed Criminal Action.
Authorities allege McCarthy shot to death 37-year-old Clinton Police officer Gary Michael on August 6, 2017.
McCarthy entered a plea of not guilty during his arraignment hearing on August 11, 2017.
According to a release from Henry County Prosecuting Attorney Richard Shields, he intends to prove several statutory aggravating circumstances, and he has given notice to McCarthy that he intends to seek the death penalty in this case.
