A New York man who allegedly fought with a Missouri State Highway Patrol trooper after a traffic stop last year in Lafayette County appeared in court and changed his plea earlier this week.
According to a probable-cause statement, Jonathan Timmons allegedly tried to grab items on the trooper’s gun belt when the trooper tried to take him into custody on February 7, 2017. With the help of a couple of people in the area, the officer was able to gain control and arrest Timmons, who also allegedly kicked a woman in the face during his apprehension.
Online court documents say Timmons was charged with a Class B Felony for Assault in the Second Degree-Special Victim; Class E Felonies for Assault in the Third Degree and Attempting to Disarm a Peace Officer While Performing Official Duty; and three misdemeanors, including one for Resisting or Interfering with an Arrest, Detention or Stop. Timmons originally entered a plea of not guilty on June 19, 2017.
During his hearing on March 5, Timmons reportedly changed his plea to guilty to three of the charges as part of a plea agreement. The other charges reportedly were dropped by the court. He was sentenced to one year in the Lafayette County Jail on each count. However, the sentences, which were ordered to run concurrent with each other, were suspended, and Timmons was placed on five years of supervised probation.
Timmons’ jury trial that was set for early April has been canceled.
