A Marshall man has been charged with two felonies for allegedly being inside the abandoned old Fitzgibbon Hospital building and being in possession of some specific tools on June 22.
According to a probable-cause statement, a law-enforcement officer noticed the doors to the building in the 800 block of South Brunswick to be open. The officer investigated due to knowing subjects had been stealing copper from the building.
Once inside, the officer located Howard Ray Winfrey in the rafters. During a consented search of a drawstring bag, authorities say Winfrey had a pry bar, a hammer, gloves and a functioning flashlight.
According to online court documents, a warrant has been issued and Winfrey has been charged with a Class D Felony for Burglary in the Second Degree and a Class E Felony for Possession of Burglary Tools. Bond has been set at $10,000 cash only, with some of the conditions being he is not to possess a firearm or have any contact with the building.
Winfrey’s initial hearing at Saline County Circuit Court is pending.
