A Marshall man who has been arrested and formally charged in connection with a shooting incident which left one dead on Saturday, December 29, 2018, in Marshall appeared in court on Wednesday, January 2, 2019.
According to a news release from the Marshall Police Department, at approximately 6:14 p.m., officers responded to a disturbance in progress on Viking Lane. Upon arrival, 31-year-old Joshua Charles Smith, of Marshall, was found to have sustained injuries from an apparent gunshot wound, was transported by ambulance to Fitzgibbon Hospital for treatment, and later was pronounced deceased.
According to online court documents, on December 30, a warrant was issued and 55-year-old James Scott Miller has been charged with a Class A Felony for Second-Degree Murder and an Unclassified Felony for Armed Criminal Action.
During his arraignment hearing, Miller’s $500,000 cash-only bond was paid in full. The conditions of bond include: he is not to leave his home address nor Saline County without consent of the court; and he is to wear a GPS monitoring device.
Miller’s cause has been continued for a conference call regarding additional bond conditions at 11 a.m. on Thursday, January 3.
Miller’s next hearing is scheduled to be held at 9 a.m. on Wednesday, January 30, at Saline County Circuit Court.
