Two court proceedings involving a 55-year-old Marshall man who has been charged with murder are scheduled for this week.
James Scott Miller has been charged in connection with the shooting death of 31-year-old Joshua Charles Smith, of Marshall, on December 29, in Marshall.
Online court documents say Miller has been charged with a Class A Felony for Second-Degree Murder and an Unclassified Felony for Armed Criminal Action. He originally posted $500,000 cash-only bond on January 2. However, a warrant was issued for probation violation on January 23, and Miller was taken into custody again on January 24.
After hearing arguments by each side on February 14 regarding bond conditions; and a phone conference on February 15, Miller’s cause has been continued for a case review at 9 a.m. on Wednesday, February 20; and Miller’s preliminary hearing still is scheduled to be held at 9 a.m. on Friday, February 22, at Saline County Circuit Court.
