A Brookfield man has been charged with several felonies relating to an alleged incident of driving while intoxicated with an infant present in the vehicle earlier this week in Linn County.
A probable-cause statement says Brookfield Police officers responded to a disturbance in the 200 block of East Canal Street on May 5. The reporting party stated they were working outside and yelled at a driver to slow down their vehicle due to children playing nearby. The driver of the vehicle–later identified as 31-year-old Joshua Rainey–reportedly turned the vehicle around and confronted the victims. Rainy alleged swung his fist at one of them, but did not make contact.
While en route, officers noticed Rainy’s vehicle and attempted a traffic stop, where he eventually pulled over after traveling several blocks in an alleged attempt to flee. Officers apprehended Rainey and searched his vehicle, where the officers found a partial bottle of alcohol and some marijuana. Also, officers noticed a 5-month-old child in a car seat in the back of the vehicle. During the booking process, Rainey reportedly had a blood-alcohol level of 0.127.
Online court documents say Rainey has been charged with a Class D Felony for Endangering the Welfare of a Child in the First Degree and Class E Felonies for Driving while Revoked and Resisting Arrest by Fleeing-Creating a Substantial Risk of Serious Injury or Death to Any Person. He also was charged with misdemeanors for assault, possession of marijuana and BAC level.
An initial hearing for Rainey is pending at Linn County Circuit Court.
