Charges against a rural Kingsville man for allegedly killing his brother without cause on March 3 have been dropped for now.
According to a post on the Johnson County Sheriff’s Department’s Facebook page, deputies were dispatched to a residence in Kingsville in regards to a shooting incident that occurred between two brothers. Upon arrival, a deputy reportedly observed a 57-year-old man lying unresponsive on the living-room floor with apparent gunshot wounds.
According to online court documents, 54-year-old Victor Dane Sanders was charged with a Class B Felony for Voluntary Manslaughter; two counts of a Class D Felony for Unlawful Possession of a Firearm; another Class D Felony for Possession of a Controlled Substance; and an Unclassified Felony for Armed Criminal Action.
However, Johnson County Prosecuting Attorney Rob Russell says he dismissed the charges without prejudice- which means “should we get additional evidence or the evidence changes, we could refile it. The dismissal was filed because after I received all of the reports, the autopsy and the toxicology lab, there’s sufficient evidence for the state to believe that this was done in self defense.”
