Another motion has been filed to revoke bond for a Marshall man accused of murder in Saline County.
According to online court documents, due to a bond-supervision violation report filed by Carroll County Supervision Services, Saline County Prosecuting Attorney Tim Thompson filed the motion to revoke bond for 55-year-old James Scott Miller on Friday, July 26. A hearing date has not been set.
During a motion hearing on Monday, July 22, the court ruled that based on the evidence presented by the state, including two exhibits, and defense, including one exhibit, the state’s motion to revoke Miller’s bond was denied.
Miller has been charged in connection with the shooting death of 31-year-old Joshua Charles Smith, of Marshall, on December 29, 2018.
Miller has been charged with a Class A Felony for Second-Degree Murder and an Unclassified Felony for Armed Criminal Action. He posted $500,000 cash-only bond on January 2; but he was arrested for violation of his bond conditions on January 24. On February 20, Miller posted an additional $250,000 cash or surety bond.
Miller pleaded not guilty on March 11.
A case review in the matter is scheduled to be held on Monday, September 23; a pre-trial conference is set for Monday, December 9; and Miller’s jury trial is scheduled for January 14 and 15, 2020, at Saline County Circuit Court.
