It has been confirmed by a spokesperson at the Missouri Attorney General’s Office in Jefferson City that a Marshall man charged with second-degree murder is now free; and the office will not be issuing a press release in the matter.
James Scott Miller was charged with a Class A Felony for Second-Degree Murder and Armed Criminal Action in relation to the shooting death of 31-year-old Joshua Charles Smith on December 29, 2018.
The spokesperson said the special prosecutor who was appointed to the case said “the evidence in this case did not warrant charges.”
Miller pleaded not guilty on March 11, 2019.
A jury trial for Miller was set for January 14 and 15, 2020. However, that event was taken off of court documents in late 2019.
