A Higginsville man is facing several charges including a couple of felonies following an incident on Thursday, December 10.

According to a statement from the Higginsville Police Department, an officer was dispatched to a residence at 104 W. Fairground Avenue in response to a domestic disturbance. When officers arrived they were advised that 29-year-old Kevin Lewallen had kicked in the back door to the residence. According to witnesses after entering the home, Lewallen attempted to forcefully remove his four month old child from a bouncy chair. Witnesses claim that Lewallen had a bottle of alcohol in his hand and appeared to be intoxicated. When the calling party attempted to stop Lewallen he smacked them in the face and exited the home with the child and the alcohol. Lewallen then aggressively placed the child into the front passenger seat of the vehicle, without a carseat and sped off to an unknown location.

Lewallen was later located at a residence in the 2200 block of Oak Street in Higginsville and was placed under arrest. While officers attempted to put handcuffs on Lewallen he began behaving in an aggressive manner and began to resist. Officers had to place him on the ground where he continued to resist and an officer had to use OC spray to get him to stop resisting. Lewallen was transported to the Lafayette County Jail and placed on a 24-hour hold.

Court documents indicate Lewallen is charged with a Class D Felony for Endangering the Welfare of a Child, a Class E Felony for Resisting Arrest and misdemeanor charges for Domestic Assault in the Fourth Degree, Assault in the Fourth Degree and Property Damage in the Second Degree.

Lewallen entered a plea of not guilty during his arraignment on Monday, December 14. His next court appearance is scheduled for 9:30 a.m. on Wednesday, December 23 at Lafayette County Circuit Court.
