A 63-year-old Warsaw woman continues her fight in court after being charged with a couple of felonies after law enforcement responded to a domestic disturbance call on Tuesday, December 22, 2020.

Just before 6:30 a.m. on December 22, the Benton County Sheriff’s Department received a call in reference to a domestic disturbance where a male subject was shot and killed. According to the Missouri State Highway Patrol report, it appeared that the victim had died as a result of a single gunshot wound to the upper torso of his body. It was determined that Patricia Garvey of Warsaw had retrieved the shotgun while arguing with the victim.

Garvey reportedly told authorities she had retrieved the firearm after a brief break in the domestic dispute. While walking through a furniture crowded living room, Garvey said the victim continued to be hostile towards her. Garvey explained while standing and still communicating with the victim, one her left hand was on the pump action of the shot gun while holding a cordless phone and her right hand was on the handle of the shotgun with her finger on top of the trigger mechanism. According to Garvey, the victim began to approach her, he then swiped the muzzle of the gun to the side, at which time the gun went off and struck the victim near his left shoulder. The victim died as a result of his injuries.

Garvey is charged with a Class C Felony for Involuntary Manslaughter in the First Degree and an Unclassified Felony for Armed Criminal Action. The Court amended Garvey’s original bond from $200,000 to $25,000 cash or surety. Garvey posted $25,000 surety bond on December 29, 2020.

According to court documents Garvey has no previous convictions or crimes involving violence.

Garvey’s initial appearance was held Wednesday, December 23. Her next court proceeding is scheduled to be held at 8 a.m. on Tuesday, March 16, 2021 at Benton County Circuit Court.
