On December 26, The Lexington Police Department was dispatched for a disturbance at a residence located in the 500 block of Rodrick Lane

While arriving at the scene police stated that they heard a gunshot fire as they turned the corner onto the street of the scene.

Police stated they observed a male put a handgun down and raise his arms straight up. As well as shattered glass on the front porch.

The suspect was detained.

The Lexington Police Department was able to come in contact with the victims and proceed with the questioning procedure.

According to the victims, Cutter is the husband of one of the victims, and is having a hard time dealing with the separation.

The suspect was identified as 41-year-old Benjamin Cutter.

Cutter was transported to Lafayette County Jail, where he was charged with attempted burglary in the first degree, and Unlawful use of weapon.

No bond is set.
