The City of Marshall and the developer of a proposed residential subdivision remain in disagreement over how to proceed with plans for over 100 homes in the western part of the city.

KMMO News has obtained a letter sent Wednesday, Oct. 1 by Mayor Craig Thompson to developer Mark Rowden, reiterating the city’s position that, “the City will not waive or alter the mandatory bonding, stormwater, and subdivision requirements that apply under state law or City code.”  It’s the latest communique in a back-and-forth that has picked up over the past month as part of Rowden’s effort to build the Meadows at Harvest Creek on West Vest Street.

Rowden appeared before the city council at their previous meeting Sept. 16. The Waynesville-based developer noted that since being invited by community members to build needed housing inventory in Marshall, he had visited the city at least 20 times. He expressed to the council his continued interest in bringing the development to fruition.

Rowden said he initially built subdivisions in unincorporated Pulaski County because at the time, Waynesville had additional requirements that he said made development difficult. He told the council that’s changed in the past couple of years.

Rowden has sought from Marshall a waiver from the city’s stormwater requirements. City administrator JD Kehrman told KMMO News those requirements are in place because Marshall is covered by Municipal Separate Storm Sewer System or MS4 regulations from the Missouri Department of Natural Resources.

Kehrman says since Rowden submitted his initial proposal about a year ago, the city has had three engineers, most recently Lamp Rynearson, review submitted plans. He added that Rowden’s most recent submission in early September showed few changes from plans submitted in May, which Lamp Rynearson deemed deficient.

The Marshall City Council was scheduled to meet Monday night in a special closed session. The agenda for Tuesday’s council meeting does not include items specific to the Meadows at Harvest Creek.
