
The Missouri Court of Appeals for the Western District has issued a stay, allowing Pettis County to continue enforcement of its ordinance restricting the development of solid waste collection facilities.
The stay issued Monday, Jan. 5 puts on hold the decision handed down by a Moniteau County judge in October, which had struck down key provisions of a 2022 order passed by the Pettis County Commission aimed at preventing the development of a landfill outside La Monte. The stay is in place until the county’s appeal is heard and a decision reached.
The appeal comes as the Missouri Department of Natural Resources continues to review testimony submitted in the request by Presidio Environmental to construct and operate a solid waste management facility on 628 acres along Buckley Road. The public comment period closed December 29th. Meanwhile, a bill prefiled in the Missouri House by Rep. Brad Pollitt (R-Sedalia) would allow counties to adopt ordinances similar to the language used by Pettis County.
