A Lexington man who allegedly assaulted another man with a baseball bat on November 8 has been charged with two felonies.
A probable-cause statement says an ex-boyfriend of a resident of the house reportedly was asked to leave on more than one occasion because he was not wanted. He left a couple of times but returned each time. He also reportedly tried to forcibly enter the residence, but the door was locked. The resident of the house reportedly had a protection order against the man and told him authorities were going to be called.
Joseph White IV told authorities he was in fear for the well being of his family- including kids- so he grabbed a baseball bat and walked out of the residence to tell the visitor to leave. He says the man charged and swung at him three times. As this was happening, White says he was backing up and swung the bat, which hit the man in the left side of his head. White says the man fell to the ground and hit his face on the driveway. The man who was injured had to be transported to the hospital, and X-rays reportedly showed he had suffered two skull fractures.
According to online court documents, 40-year-old White has been charged with a Class A Felony for Assault in the First Degree- Causing Serious Physical Injury; and an Unclassified Felony for Armed Criminal Action.
White pleaded not guilty during his arraignment hearing and posted $50,000 surety bond on November 14. White’s next hearing is set for 9:30 a.m. on December 5 at Lafayette County Circuit Court.
