A court proceeding involving a 55-year-old Marshall man who has been charged with murder is scheduled for Friday, February 15.
James Scott Miller has been charged in connection with the shooting death of 31-year-old Joshua Charles Smith, of Marshall, on December 29, in Marshall.
Online court documents say Miller has been charged with a Class A Felony for Second-Degree Murder and an Unclassified Felony for Armed Criminal Action. He originally posted $500,000 cash-only bond on January 2. However, a warrant was issued for probation violation on January 23, and Miller was taken into custody again on January 24.
During a case review on Friday, February 8, the state objected to the defendant’s request to review conditions for his release. The state requested the opportunity for the victim’s family to be heard and present evidence in opposition to the setting of conditions of bond. The court heard the arguments during a hearing on Thursday, February 14.
The cause has been continued for a phone conference- with the court to review the matters pending and to schedule additional hearings as required- at 10 a.m.; and Miller’s preliminary hearing is scheduled to be held at 9 a.m. on Friday, February 22, at Saline County Circuit Court.
