The preliminary hearing for a 55-year-old Marshall man who has been charged with murder and was released on bond for a second time earlier this week has been postponed.
James Scott Miller has been charged in connection with the shooting death of 31-year-old Joshua Charles Smith, of Marshall, on December 29.
Online court documents say Miller has been charged with a Class A Felony for Second-Degree Murder and an Unclassified Felony for Armed Criminal Action. He originally posted $500,000 cash-only bond on January 2. However, a warrant was issued for violation of his bond conditions on January 23, and Miller was taken into custody again on January 24.
After hearing arguments by each side on February 14 regarding bond conditions; and a phone conference on February 15, along with objections from the prosecuting attorney, Miller posted additional $250,000 cash or surety bond, with several conditions.
Online court documents also say a phone conference call was set for Thursday, February 21, to clarify the GPS conditions of Miller’s release and resetting of his preliminary hearing. No other information is available at this time.
Miller’s preliminary hearing was scheduled to be held at 9 a.m. on Friday, February 22. His next hearing is pending at Saline County Circuit Court.
